Law commission formed against expropriation

AMED - A law commission has been formed against "urgent expropriation" which has been declared in the Sur district of Diyarbakır by cabinet decision. One of the members of this commission lawyer İlknur Alcan, who is the board member of Libertarian Jurists Association (ÖHD) Istanbul Branch, said, "We will apply to the protection boards and we will file a claim to administrative court and State Council to cancel the decision. All people must apply to law commission which we have formed."

Lawyers formed a law commission against "urgent expropriation" which has been declared in the Sur district of Diyarbakır by cabinet decision. The Human Rights Association, Diyarbakır Bar Association, Mesopotamia Jurists Association (MHD), Diyarbakır Metropolitan Municipality, Local Administrations of Democratic Region Party (DBP) and Libertarian Jurists Association (ÖHD) have formed a office in front of Ulu Mosque in Sur. We talked to one of the members of this commission lawyer İlknur Alcan, who is the board member of Libertarian Jurists Association (ÖHD) Istanbul Branch about the commission. İlknur said, "The aggrieved people must apply our commission with their documents. The commission will apply in behalf of them.

"We will apply to the protection boards and we will file a claim to administrative court and State Council to cancel the decision. They announced that the expropriation of the Sur district is for the security reasons. However, no war has been declared here. This decision is an arbitrary treatment. Sur was declared as risk area in 2012 and they base on this decision. This decision was made but it has never transferred into practice. We have to file a claim to cancel this decision, too."

İlknur pointed out that Sur is a cultural heritage area. "Many building in the town are registered. The town has been protected with different law out of Disaster Law. If you want to change something in the town, you have to get permission for them to protect the cultural property," said İlknur.

İlknur also said that they will apply to UNESCO and European Commission to protect cultural heritage and the human housing right. UNESCO has declared this area as cultural heritage. This urgent expropriation decision is against the decision of UNESCO and it is a violation against the human housing right. İlknur called on all people to apply law commission with the documents.
